Terms of Service

1. The Service

Smart CRO Agent provides an AI-powered website audit tool that analyzes publicly accessible URLs and generates CRO, SEO, AEO, GEO, and UX recommendations using Google's Gemini AI model. The service is provided "as is" and is subject to change.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By registering, you confirm that the information you provide is accurate and that you have authority to agree to these Terms.

3. Your Account

• You are responsible for maintaining the security of your password and account.
• You must not share your account credentials or allow others to access your account.
• You must notify us immediately if you suspect unauthorised access.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Submit URLs you do not own or have authorisation to audit.
• Use the service to audit sites that contain illegal, harmful, or abusive content.
• Attempt to reverse-engineer, scrape, or extract our AI prompts, models, or scoring algorithms.
• Use automated scripts to make requests beyond your plan's credit limits.
• Resell, white-label, or sublicense the service without a written Agency agreement.

5. Credits & Billing

Free plan credits (5/month) reset monthly. Paid plan credits reset on your billing anniversary. Unused credits do not roll over. We do not issue refunds for used credits. Pro and Agency plans are on a waitlist — no charge occurs until billing is activated.

6. Audit Results & AI Limitations

Audit reports are generated by AI and are recommendations, not guarantees. We do not guarantee specific conversion rate improvements, search ranking changes, or revenue outcomes. All suggestions should be reviewed by a qualified professional before implementation. Results depend heavily on your specific niche, audience, and site infrastructure.

7. Intellectual Property

The Smart CRO Agent platform, brand, AI prompts, scoring models, and UI are our intellectual property. Your audit reports are yours — you may use them internally or share them with clients. You may not republish or distribute audit reports as your own product.

8. Availability & Uptime

We target 99.5% monthly uptime but do not guarantee uninterrupted service. Planned maintenance is announced on our Status page. We are not liable for losses caused by downtime or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Smart CRO Agent's total liability to you for any claim arising from use of the service is limited to the amount you paid us in the 3 months prior to the claim. We are not liable for indirect, consequential, or punitive damages.

10. Termination

You may delete your account at any time. We may terminate or suspend your account for material breach of these Terms, with or without notice. On termination, your data will be deleted within 30 days.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or an in-app notice. Continued use after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, unless mandatory consumer protection laws in your jurisdiction require otherwise.
